The Supreme Court on Monday rejected a plea seeking menstrual leave for woman employees and asked the Centre to hold talks with all stakeholders and state governments to decide if a model policy can be framed in this regard.
“Menstrual leaves may encourage women for bigger participation in the workforce, but mandating such leaves may lead to women being shunned from workforce. We do not want that,” the SC observed.
The top court said that what it tries to do to protect woman can act to their disadvantage, adding that it’s a policy decision which can be looked into by Centre and states.
The court then asked the petitioner to move before the Ministry of Women and Child Development with the plea.
