The Delhi High Court has sought a response from the Delhi government while hearing a petition that flagged that the Delhi Waqf Tribunal has been without a member for two years.
Masjid and Dargah Abdul Salam, a mosque in Delhi’s Connaught Place, has filed a petition in the Delhi High Court. In the petition, it flagged that the Delhi government never notified the appointment of a member of a tribunal two years ago when the previous member was transferred out.
As a result of the Delhi government’s inaction, the petition has said that the Delhi Waqf Tribunal has been inactive for two years, according to Bar & Bench.
The report said the petition further told the court that the inaction on the Delhi government’s part led to an increased pendency of cases at the tribunal and further pressure on the High Court as people approached the court since the tribunal was not working.
“The petitioner [Masjid and Dargah Abdul Salam] is party to various litigations before the learned Waqf Tribunal involving the portions of the Waqf premises under reference. However, for want of Notification as required under Section 83 (1) of the Waqf Act, 1995, the trial of all those suits has abruptly come to a grinding halt, which causes serious injury to the petitioner,” the petitioner was quoted as saying.
After issuing a notice to the Delhi government, Justice Subramonium Prasad of the Delhi High Court posted the matter to July.
The waqf boards are statutory bodies that exercise control over the ‘waqf’. A waqf is a property dedicated in Islamic traditions for religious and charitable uses. Waqfs are governed by Waqfs Act, 1995.
